Planners OKs zoning change for tract on U.S. 71

Changing the zoning of property at 5 Bella Vista Way from residential to commercial received Planning Commission approval Monday night.

During Monday night's meeting in City Hall, commissioners also approved a property-line adjustment on Cold Cave Drive and a lot split in the city's planning area alongside Spanker Creek Road.

The first order of business was the rezoning of 5 Bella Vista Way, which is near the state line. Commissioners approved the change, sending it on to City Council for final action. The zoning change is from residential (R-1) to commercial (C-1).

The applicant, Gene Groseclos, is an attorney with Cooper Communities who represents Pat Cooper.

"She has requested that the zoning be changed," he said. "The property is uniquely situated. It's the only R-1 zoned property on that street."

Groseclos said that the intent is to set up a bed and breakfast, and that there are no plans in place that would cause any sort of light or noise disruption.

A handful of residents living near the property had objections.

"I adamantly reject this rezoning to commercial," said Elaine Rosen.

Rosen said that, while she is not opposed to a bed and breakfast, she worries that the property could change hands and a commercial zoning could allow different sorts of businesses to move into that space.

With prior occupants having dogs, she said, she knows for sure that she can hear noise from this property at her home.

"A year from now it could be a 24-hour Waffle House," she said, "with cars coming in and out and people yelling in the parking lot."

Another concern, she said, is that the letter of notification nearby residents received did not have the correct address for City Hall. This meant, she said, that the city may not have received some letters from concerned residents.

The second piece of business, a property line adjustment on Cold Cave Drive, was intended to combine 5 lots along the east side of Lake Bella Vista into a single parcel. It was approved, and will go on to the council.

The final piece of business was a lot split on Spanker Creek Road, with refinancing of the home on this property in mind. This was also approved, and will move on to the city council.
